Ontario has recently enforced stricter regulations for sports betting advertising. These rules now explicitly prohibit the use of athletes, celebrities, and individuals likely to attract underage audiences in gambling ads.

The main goal is to reduce the promotion of gaming to younger demographics and limit the use of familiar faces that have traditionally fueled excitement around gambling-related advertising.

These changes are part of a broader initiative to control the promotion of online sportsbooks, addressing the significant surge in online gambling advertisements, particularly during live sports events.

Ontario’s decision to restrict the involvement of athletes in online gambling advertising is a significant step in lessening the impact of sports betting ads, especially on younger viewers. Under the new rules, sports betting ads in Ontario will no longer feature athletes and celebrities.

The catalyst for this regulatory focus on advertising stems from what Burns dubs a “very emotional debate.” Concerns about the saturation of sports betting ads, particularly on television, prompted the AGCO to propose amendments last April. While the initial proposal raised eyebrows, the AGCO demonstrated flexibility by engaging with industry stakeholders to address their apprehensions.

Effective February 28, 2024, the revised standards place stringent restrictions on the use of athletes, celebrities, and influencers in advertising. Burns acknowledges the challenge in defining who “would likely be expected to appeal to minors,” likening it to the ambiguity of Lake Huron’s winter weather. Despite this, he emphasizes the need for operators to adapt to these changes.

However, Burns raises a valid concern about the lack of factual basis for the amendments. He points to the decline in minors watching television and the stabilization of the advertising frenzy in Ontario.

Burns also highlights the lingering ability of non-regulated operators to advertise without repercussions, creating an uneven playing field.

As the industry navigates these changes, Burns advocates for a more informed approach, urging stakeholders to consider the facts. He stresses the importance of understanding the evolving landscape, including the maturation of the market and the nuanced dynamics of advertising in a regulated environment.
